The processing and safekeeping of personal data in compliance with the Personal Data Protection Law No. 6698 (“KVKK”) is a matter of importance. 1. What Is Personal Data?

Personal data is defined in the Personal Data Protection Law No. 6698 as “any information relating to an identified or identifiable natural person”. As the definition indicates, any data that makes you identifiable is personal data. Accordingly, your personal data cannot be obtained and processed by anyone else without your express consent. In addition, political opinion, sect, race, religion, association or foundation membership, health information, philosophical belief, faith, sexual preference, criminal record, criminal conviction data and biometric data constitute special categories of personal data. Obtaining, transferring and processing your special categories of personal data requires your separate and express written consent. All explanations and statements made in this Privacy Notice concerning your personal data also cover your special categories of personal data.

2. Legal Basis

The Personal Data Protection Law No. 6698 requires that data subjects be separately and expressly informed about the data collected at the time their consent is obtained. This requirement, known as the obligation to inform, is set out in Article 10 of the Law as follows: “During the collection of personal data, the data controller or the person authorised by it is obliged to inform the data subjects about the identity of the data controller and its representative, if any; the purposes for which the personal data will be processed; to whom and for what purpose the processed personal data may be transferred; the method and legal basis of collection of personal data; and the other rights listed in Article 11.

Article 3 of the Law defines the data controller as “the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system”. The data processor is defined as “the natural or legal person who processes personal data on behalf of the data controller upon its authorisation”. 3. Scope of the Data Controller’s Obligation to Inform

  2. informing you promptly of developments within the Company and of the products and services offered;

  3. identifying individual needs and intended uses, and thereby providing our customers with tailored goods and services;

  4. carrying out the Company’s commercial activities and thus ensuring complete performance towards you;

  5. informing you about our changing and developing products and services and, where necessary, providing the required notices;

  6. enabling you to benefit in the best possible way from the products and services offered by our Company;

  7. developing, determining and placing on a sound footing our commercial partnerships and strategies, and taking sound decisions in our commercial policies and management processes;

  8. placing our corporate identity on a sound footing and ensuring corporate functioning;

  9. achieving the objectives of our internal policies and thereby increasing the satisfaction of our customers;

For all these purposes, personal data is processed in accordance with the “conditions for processing personal data” set out in Articles 5 and 6 of the Personal Data Protection Law No. 6698.

5. Principles Applied to the Processing of Your Personal Data

As a Company, we have adopted the following principles:

  • retaining data only for the period foreseen in the relevant legislation or required for the purpose of processing;
  • processing data lawfully;
  • keeping data up to date;
  • acting in accordance with the rule of good faith;
  • not using data outside the purpose for which it is processed;
  • keeping processing proportionate to and limited by its purpose;
  • processing data in accordance with general morality, custom and practice;
  • processing data in compliance with all applicable legislation, in particular the provisions of the Personal Data Protection Law No. 6698.

6. Method of Processing Personal Data

a. Your personal data is retained and processed by the Company in two situations:

  • where you have given your express consent; or
  • where one of the conditions of lawfulness set out in the Law applies.

b. Situations in which express consent is not required

The Personal Data Protection Law No. 6698 provides that, in certain situations, express consent is not required for data to be processed and retained. These situations, set out in Article 5(2) of the Law, are as follows:

  • where it is expressly provided for by law;
  • where it is necessary for the protection of the life or physical integrity of the person concerned or of another person, where that person is physically or legally incapable of giving consent;
  • where processing personal data of the parties to a contract is necessary, provided that it is directly related to the conclusion or performance of that contract;
  • where it is mandatory for the data controller to fulfil its legal obligations;
  • where the data has been made public by the data subject;
  • where data processing is mandatory for the establishment, exercise or protection of a right;
  • where data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Where these situations exist, the Company is entitled to process data without your express consent.

7. Methods by Which Your Personal Data Is Collected by the Company

In changing and developing technological conditions, our Company collects data through different channels. The methods of collection vary. Without limitation, our data collection methods include: the website, social media channels, instant messaging tools, e-mail, telephone, fax, manual methods, contracts, all documents and records submitted to our Company for the performance of the work, and mobile applications. Personal data and special categories of personal data collected by these methods may be accessed verbally, in writing and electronically.

Personal data and special categories of personal data collected by the Company may be processed and transferred within the framework of the conditions set out in this Privacy Notice, in accordance with the conditions, purposes and principles of the Personal Data Protection Law No. 6698 explained above.

8. Transfer and Protection of Data

a. Transfer

Your data is transferred in accordance with the Personal Data Protection Law No. 6698 and the conditions of our confidentiality undertaking, solely for the purpose of performing the work. The Company acts with full care during the transfer process and endeavours to transfer the least possible amount of personal data. In this context, the Company transfers data to its solution partners and to companies acting as performance assistants.

b. Protection

The main aim of the Personal Data Protection Law No. 6698 is to protect data and to prevent unauthorised transfer. In order to prevent the transfer of data to unauthorised third parties, and in particular in accordance with the provisions of the Law, we take all necessary technical and administrative measures as a Company. In this context, we bring our internal policies into line with the Personal Data Protection Law and maintain all kinds of technical software and hardware for the protection of personal data. In order to achieve all of this, we seek to prevent both our employees and the third parties we work with from acting contrary to our Privacy Policy.

9. Rights of the Data Subject

a. General information about applications

Article 11 of the Personal Data Protection Law No. 6698 sets out the rights of the data subject. Pursuant to this Article, your rights as a data subject are as follows:

  1. To learn whether their personal data is being processed;

  2. To request information if their personal data has been processed;

  3. To learn the purpose of processing and whether the data is used in accordance with that purpose;

ç) To know the third parties, in Türkiye or abroad, to whom their personal data has been transferred;

  1. To request rectification of their personal data if it has been processed incompletely or inaccurately;

  2. To request erasure or destruction of their personal data within the conditions set out in Article 7 of the Law, titled “Erasure, destruction or anonymisation of personal data”;

  3. To request that the rectification of incomplete or inaccurate data, or the erasure or destruction of data upon the data subject’s request, be notified to the third parties to whom the personal data has been transferred;

  4. To object to a result arising against the data subject through analysis of the processed data exclusively by automated systems;

  5. To claim compensation where the data subject suffers damage due to the unlawful processing of their personal data.

You may submit your requests concerning the rights arising from the Personal Data Protection Law explained above to our Company in accordance with the procedure set out in this Privacy Notice. Your requests will be answered by the Company within thirty days at the latest. Applications must be made personally by the data subject. The Company will take into account only applications made by the data subject and will share information about the applicant only with that person. Applications are free of charge; however, if a fee is prescribed by the Personal Data Protection Board, our Company may request the fee determined by the Board.
